Terms of Service

1. Service Description

Phynite Analytics is a subscription-based web analytics platform designed for website owners, particularly food bloggers and small business owners. The Service connects to your Google Analytics 4 (GA4) account and generates simplified reports from your data, including metrics such as page views, sessions, users, engagement rate, and referral traffic. We may also integrate with third-party platforms like Google Search Console, Pinterest, Instagram, and TikTok.

2. Eligibility

You must be at least 18 years old and capable of entering into a legally binding agreement to use the Service. By using the Service, you represent and warrant that you meet these requirements.

We reserve the right to restrict access to the Service for individuals or organizations whose business interests we determine, in our sole discretion, to be incompatible with the Service. This includes, but is not limited to, employees, contractors, or representatives of advertising networks, ad management platforms, or companies that offer products or services that compete with Phynite Analytics. This restriction applies to both direct account registration and team member invitations.

3. User Accounts and Access

To use the Service, you may be required to create an account and provide access to your GA4 data. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Subscription and Payment

Phynite Analytics is offered on a subscription basis:

• $60 per month or
• $600 per year (billed annually)

By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel. All payments are non-refundable.

5. Cancellation and Termination

You may cancel your subscription at any time through your account settings. However, we do not offer refunds for any portion of a billing period already paid. We reserve the right to suspend or terminate your access to the Service at any time for violation of these Terms or applicable laws, including misrepresentation of eligibility under Section 2.

6. Data and Privacy

We access your GA4 data only with your authorization. This data is processed and stored within Google Cloud, which powers our platform infrastructure. By using the Service, you consent to our collection and use of data as described in our Privacy Policy.

We do not sell or share your personal or analytics data with third parties except as required to provide the Service or as required by law.

7. Third-Party Services

Phynite Analytics may integrate with third-party platforms (e.g., Google Search Console, Pinterest, Instagram, TikTok). Use of these services is subject to their respective terms and policies. We are not responsible for the content or practices of third-party services.

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee the accuracy, completeness, or usefulness of any data or reports provided.

9. Limitation of Liability

To the fullest extent permitted by law, Phynite Solutions, LLC shall not be liable for any indirect, incidental, special, or consequential damages, or loss of profits or data, arising out of your use or inability to use the Service.

10. Modifications

We may update these Terms from time to time. If we make material changes, we will notify you by email or via the Service. Continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.

11. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles.
